Toshiba 42HL167 LCD - ATSC and Dolby Digital

The customer cannot get DD output from his ATSC tuner at all times. Sometimes the menu functions are grayed out and cannot be adjusted. It was suggested that the reason he does not get DD is because the station is not sending DD all the time.
My understanding is that a station has an audio encoder and it is set for what ever they set it for, this case being DD, and then they feed it what ever - from mono to stereo to multi-channel. Regardless of all that the audio signal remains in DD from the station to your receiver and the station never changes that. Your A/V receiver always says DD regardless of how many channels of audio are heard.
For those of you on OTA, is that correct?
