Summary

Dale Cripps criticizes CBS local affiliates for refusing to grant DirecTV satellite waivers to viewers who cannot receive over-the-air signals, particularly for the Super Bowl. He argues that signal theft by a few bad actors has poisoned trust between affiliates, satellite providers, and viewers, blocking legitimate HDTV access on the biggest TV day of the year.

Dear Readers:

From forums and emails to me I know that many of you are disappointed with the CBS DirecTV outcome, especially for the Super Bowl. Yes, anywhere there are CBS owned stations the satellite company is authorized to give you the signals with a waiver automatically granted. Where independent affiliates own the CBS outlet that is another story. There, you are required to get a waiverm and this is not easily granted with it often taking 45 days prior to any response. CBS has their hands tied on this one unless they want to break the sacred bond they have between them and and their affiliates. Considering the dramatic decrease in network viewing this year that is not a choice anyone is going to easily make. The ship must hold together during these choppy seas. Those affiliates who have chosen to not grant any waivers for even the Super Bowl are not thinking clearly with respect to whom they serve and from where their pay check comes. Yes, we who sympathize with them can say, "But they need the revenue from the Super Bowl and to grant waivers means they would lose some viewers from their own signals and that means less dollars from their own local advertisers. This is THE BIG GAME and a time when they can make a few bucks from  the added concentration of viewers on this national television events day."

I don't know how many HDTV viewers would turn to a DirecTV feed if they could already get the local CBS affiliate signal rock solid? What would be the point? It is only you who cannot receive this 8-VSB signal from those affiliate towers or cable that are at stake here. Yet, they won't do it, and the reason is that they feel they have been cheated in the past by people using bogus addresses to get satellite feeds from the networks when they shouldn't have by law had that privilege. There are people who brag on public forum about how easy it is to steal unauthorized signals. Don't remain part of this magazine if you are one who practices this theft, or change your ways. I don't want to be associated with such activities. The satellite companies have not policed this action very well either and so there is a major distrust that has been whipped up over time between the affiliates, the satellite companies, and even their broadcast companies. You are the pawns in this game of retaliation. The drill sergeant is making the entire platoon do pushups because a few hidden scoundrels short sheeted his bed. It;s cute. It's fun. It's delightfully antiestablisment naughty, and all it cost was the platoon's sweat. No, it cost a lot more. It cost trust. And without trust the world spins a little slower.

The  local CBS independent affiliate that does not have a clear signal to your set and who is still not granting you a waiver for at least the Super Bowl, is just no friend of yours. If you can't be exploited, to hell with you. I am going to add one caveat to this point later. Perhaps, you are one of the local sponsors of TV programs in your area. Maybe you sponsor the news or the morning program or the weather. Call up your account executive and the general manager and point out that anything that is done to further HDTV fully enriches the nation. Tell them to look to Robert Grave's remarks made in Mexico a few weeks past to all of the Americas where he boldly declared what many have known for decades--HDTV is a benefit to the land that adopts it and to the economy of that land. Ask why these people who cannot receive signals in the first place--the only legit group to seek the waiverd--are denied them from satellite and why is it that national progress in HDTV is being obstructed? There may be no law broken here but the vision which carries us forward is clouded and the message tossed into the dirt. So, these CBS affiliates not only block you from having the Super Bowl (and they cannot profit from someone who cannot receive their signals in the first place) but also ruin for you this unprecedented opportunity to serve this higher cause by showcasing your HDTV to your neighborhood. It is an absolutely mindless decision from, at least on the surface. I am told by CBS that we just don't understand all of the implications. That is certainly fair enough. Most people are not even competent in their jobs for five years much less understanding senior policy matters as complex as these. I think we can look at it in block diagram form though for it is not that complex. A signal that carries a high value for a local broadcaster cannot be received by someone in their area and they obstruct clearance for a substitute satellite feed that would serve that customer. There are a lot of business adjustments when there are changes, but hardly as many as had to be made on 911. The industry that can send news around the world on short term leased satellites with content that has rights management clauses all over the place can certainly find a way to satisfy their end users on the biggest TV day of the year.

Here is that caveat I mentioned earlier: If I am going out on a limb to rattle the CBS affiliates I have to warn you not to be lazy on your end. The broadcasters have laid out a tremendous amount of money and given a titan's effort to transition to HDTV and to compliment that you need to make a first class all-out effort to receive those signals that the government mandated them to send to you. It is the only fair thing to do and we increasingly must act like we are partners in this transition if HDTV is to reach its fantastic potential. If you are just looking to take the easy way out and get your DirecTV CBS Super Bowl by making a toll free phone call or, maybe two, don't blame the broadcasters for taking the same easy way out by just saying no. It is their granted right. It is not very nice from a public relations standpoint, but the rights are on their side. If it were not, there would be lawyers crawling all over this deal. But if you walk the extra mile and still can't receive those signals then call up the general manager of that affiliate and tell him or her what you have done and still without good results. If he can't fix it then with his engineers tell him to fax or email his clearance to whomever it must go at CBS and/or the satellite company just for the Super Bowl. The rest can be worked out later. I know you haven't much time but all of this just came up and to a head yesterday.

Good Viewing,

Dale
